By engaging M/s OJAS ICONIC for any Project Oriented Professional and Technical services, including but not limited to electrical system installation, testing, and commissioning, Industrial Automation, and Fire protection systems, you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you ("the Client") and M/s OJAS ICONIC ("the Company").
M/s OJAS ICONIC provides specialized services in panels/transformer installation, Testing & Commissioning in Electrical systems up to 33kV, Industrial Automation, Communication Systems, and Fire Alarm and Fire protection system services. The specific scope of work for each project will be detailed in a separate project proposal or service agreement.
The Client is responsible for providing all necessary information, access to the project site, and a safe working environment for the Company's personnel. The Client must ensure that all permits, licenses, and approvals not specified as part of the Company's scope of work have been obtained prior to the commencement of services.
Service fees will be specified in the project proposal. Payments are due according to the schedule outlined in the proposal. Late payments may be subject to interest charges. In the event of non-payment, the Company reserves the right to suspend work until the outstanding balance is settled.
The Company will make every effort to complete projects within the agreed-upon timelines. However, these timelines are estimates and are subject to change due to unforeseen circumstances, including but not limited to delays in material delivery, adverse weather conditions, or changes in the project scope requested by the Client.
The Company warrants that its services will be performed in a professional and workmanlike manner. The specific warranty period and terms for materials and workmanship will be detailed in the project proposal. The Company's liability for any damages or losses related to its services is limited to the total value of the service fees paid by the Client.
Any project-specific technical drawings, designs, or proprietary information developed by the Company for the project will remain the property of M/s OJAS ICONIC until full and final payment has been received.
Both the Client and the Company agree to maintain the confidentiality of all project-related proprietary and technical information shared during the course of the engagement. This obligation extends beyond the completion of the project.
Neither party shall be held liable for any delay or failure to perform its obligations under these terms if such delay or failure is caused by an event beyond its reasonable control, including but not limited to acts of God, war, fire, flood, or natural disasters.
The Company provides value-added services in getting CEA & CEIG approvals. While we will make every reasonable effort to facilitate these approvals, the final decision rests with the respective government authorities. The Company is not liable for any delays or rejections by these bodies.
Either party may terminate the service agreement by providing written notice to the other party. In the event of termination, the Client will be responsible for payment for all services rendered and costs incurred up to the date of termination.
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in the location of the Company's principal place of business.
These Terms and Conditions, along with the project proposal, constitute the entire agreement between the Client and M/s OJAS ICONIC, superseding all prior discussions and agreements, whether written or oral. No modification of these terms will be effective unless it is in writing and signed by both parties.
